Please read our Terms & Conditions thoroughly before placing any orders on www.botanicgardensshop.sg. We advise you to keep a copy of our Terms & Conditions for future reference. These Terms & Conditions are subject to change.
1. DEFINITIONS AND INTERPRETATIONS
1.1 "Gardens Shop" refers to the Gardens Shops located at Singapore Botanic Gardens.
1.2 "Gardens Shop Online” refers to the website on the internet with the URL address www.botanicgardensshop.sg.
1.3 "You" refers to the customer who visits the Gardens Shop Online and utilises the services available.
1.4 "Products" refer to the merchandise or products on the Gardens Shop Online.
2.1 These Terms and Conditions shall apply to all contracts and orders made with us for the sale and supply of products. By using the Gardens Shop Online, placing an order with us, giving delivery instructions or accepting delivery of Gardens Shop products, you acknowledge these Terms and Conditions and give your full acceptance of these terms.
2.2 These Terms and Conditions take precedence over any other terms put forward by the customer.
2.3 No other terms or changes to these Terms and Conditions shall be valid unless approved in writing and signed by us.
3.1 To fully utilise all of the features of this site, it is recommended that you create an account and register with us. We ask that the information that your provide us with is accurate, true and up-to-date. If any of your registration information changes, please log in to your account and make the necessary changes.
3.3 By registering with us, you agree that you will be the sole user of your account and are responsible for safeguarding your password. We encourage you to use “strong passwords” (passwords that use a combination of letters and numbers as well as upper case and lower case letters) with your account. The Gardens Shop will not be held accountable for any losses or damages that are incurred from neglect on your part in failing to keep your account details private and allowing others access to your account.
3.4 To register with the Gardens Shop Online you must be of the legal age to form a binding contract and must ensure that you are not a person barred from receiving services under the laws of the Republic of Singapore. You may use the services only in compliance with these terms and all applicable local, state, national and international laws, rules and regulations.
3.5 You must ensure that the details provided by you upon registration are complete and accurate. You must inform us immediately of any changes to the information that you have provided when registering by updating your personal details.
4. ELIGIBILITY TO PURCHASE
4.1 In order to shop with the Gardens Shop Online you are required to provide us with your real name, number, e-mail address and payment details that you confirm to be valid and correct. You also confirm that you are the person reflected in the billing information you have provided us with.
4.2 This site grants access only to individuals who comply with the Gardens Shop’s terms of eligibility. You confirm that you have been issued a valid credit/debit card by a bank recognised by the Gardens’ Shop. We reserve the right to restrict multiple quantities of an item being shipped to any one customer or postal address.
4.3 By ordering a product from us, you authorise us to perform credit checks and obtain information about you at our discretion in order to conduct the appropriate anti fraud checks. The information you provide may be disclosed to a credit reference or fraud prevention agency.
4.4 You will need to be at least 18 years of age and have been issued a valid credit/debit card by a bank that is recognised by the Gardens Shop in order to make a purchase.
4.5 You must have the authority to authorise the Gardens Shop to process the charges on the credit/debit card you use in the amount of the total purchase price for the items which you have purchased.
5.1 All orders will be charged in Singapore Dollars.
5.2 All orders are subjected to stock availability.
5.3 All orders placed will be subjected to acceptance by the Gardens Shop. All orders will be reviewed and personally processed. If the item(s) that you have requested is/are not in stock, we will contact you via your contact details provided and an appropriate course of action based on stock availability in the near future will be taken.
5.4 As all orders are subject to credit authorisation, approval by your credit card’s issuing bank and full payment are required before we prepare your order.
5.5 All sales shall not be concluded between you and the Gardens Shop until full payment is received.
5.6 The Gardens Shop regrets that any cancellation after orders have been successfully processed will not be approved.
5.7 All orders are subjected to stock availability.
6.1 There will be no contract of any kind between the customer and the Gardens Shop until the Gardens Shop dispatches the goods to the customer. The customer’s order is an offer to buy from the Gardens Shop. Nothing that the Gardens Shop does or say will amount to any acceptance of that offer until the Gardens Shop dispatches the goods to the customer. At any point before the dispatch, the Gardens Shop may decline to supply the goods to the customer without giving any reason. At the moment that the goods are dispatched, a contract will be made between the Gardens Shop and the customer.
6.2 The use of the Gardens Shop website is available for non-commercial and personal use only. The Gardens Shop reserves the right to refuse any orders from businesses or individuals that appears to be purchasing our products for commercial or other non-domestic purposes. A limit on the number of items that can be purchased through our site may also be placed to ensure the availability of all our products to our customers.
7.1 All products are in Singapore Dollars (SGD).
7.2 For international orders, the prices of the Gardens Shop Online products do not include taxes and duties, delivery charges, or any other additional charges (VAT, GST, etc.) incurred at the destination's country.
7.3 For all delivery destinations and collections within Singapore, prices are inclusive of Singapore Goods and Services Tax (GST) at the current rate in Singapore. This will be reflected during Check Out after the Delivery Option is chosen.
7.4 While all attempts are made to ensure that product prices and information are accurate, product prices listed are subject to change without prior notice.
7.5 The Gardens Shop reserves the right to amend inaccurate pricing and information in the event of a mistake.
7.6 The Gardens Shop shall have the right to refuse or cancel any orders placed for products listed at an incorrect price, whether or not the order has been confirmed and your credit card charged.
8. INFORMATION COLLECTION & USAGE
8.1 The Gardens Shop collects the details provided by you upon registration together with information we learn about you from your use of our services. By using the Gardens Shop website, you understand we may use and/or disclose any information about your demographics in a manner which will not reveal your identity for the purpose of marketing, as well as strategic development, research and customer care.
9.1 You may not use the Gardens Shops Online for any of the following purposes:
- Disseminating any unlawful, abusive, threatening, harassing, obscene, libellous, harmful or otherwise objectionable material.
- Transmitting material that encourages conduct that constitutes a criminal offence, resulting in civil liability, and/or results in other breaches of relevant laws, regulations or codes of practice.
- Gaining unauthorised access to other computer systems
- Interfering with any other person’s enjoyment or use of the Gardens Shop Online.
- Breaching any laws concerning the use of public telecommunications networks
- Making, storing or transmitting electronic or physical copies of materials protected by copyright without the permission of the owner
- These terms are applicable to any content generated or contributed by you as well including, but not limited to, comments and reviews of our products.
9.2 You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgement by a court of competent jurisdiction and all settlements sums paid by us as a result of any settlement agreed by us arising out or in connection with:
- Any claim by any third party that the use of the Gardens Shop is defamatory, offensive, obscene, is illegal or constitutes a breach of any applicable regulation, law or code of conduct.
- Any claim by a third party that your use of the Gardens Shop Online infringes the third party’s copyright or other intellectual property rights of whatever the nature
- Any penalties or fines imposed by any regulatory, advertising or trading body or authority in connection with your use of the Gardens Shop website.
10. APPLICABLE LAW
10.1 These terms and conditions shall be governed by and construed in accordance with the laws of the Republic of Singapore and any disputes will be resolved exclusively by the Courts of Singapore.
11. PROMOTION CODE
11.1 Your use of a discount code indicates your agreement to these terms and conditions.
11.2 All promotion codes are non-transferable and cannot be converted to cash.
11.3 They cannot be used in conjunction with any other promotion code or offers, and must be redeemed within the given validity period.
11.4 All codes are valid for one month from the date of issue (unless otherwise stated).
11.5 The minimum total purchase to redeem a promotion code is SGD$100 (unless otherwise stated).
11.6 All codes are valid for a one-time use only.
11.7 Codes are only valid at www.botanicgardensshop.sg
11.8 The Gardens Shop reserves the right to withdraw or cancel a discount code at any time without prior notice or explanation.
11.9 The Gardens Shop shall not be liable to any individual(s) for any financial loss arising out of the refusal, withdrawal or cancellation of any discount code or any failure or inability of a customer or household to use a discount code for any reason.
12. SECURITY & FRAUD
12.1 When you use a discount code you acknowledge that you are the duly authorised recipient of the discount code and that you are using it in good faith.
12.2 If you redeem or attempt to redeem or encourage the redemption of discount codes to secure discounts you are not entitled to, you may be committing a civil or criminal offence.
12.3 The Gardens Shop reserves the right to reject any individual who we believe to be using discount codes unlawfully, and you agree that you will have no claim against the Gardens Shop for the cancellation or rejection of any discount code under these circumstances. The Gardens Shop also reserves the right to take further action in such circumstances.
13. STATUS, COLLECTION AND DELIVERY OF ORDERS
13.1 Delivery will be made to the address provided by the customer on the completed order form. If you are having an item shipped to a different location from your billing address, please ensure that you fill in the billing and delivery addresses on the order form completely and correctly.
13.2 The Gardens Shop will deliver the customer’s order to the main entrance of the delivery address provided. Any other special delivery requests have to be confirmed and approved when purchase is first made. The Gardens Shop reserves the right to deliver to only the main entrance of the delivery address provided by you when completing the order form.
13.3 All deliveries must be received and signed for by an adult aged 18 years or over. Our delivery driver is entitled to ask the individual receiving the package for identification to verify his/her age if he/she deems it necessary.
13.4 The Gardens Shop will only deliver the package to the customer who ordered the goods due to safety reasons. If the customer is unable to receive the package but would like to assign another individual responsibility for receiving the package, the name of the recipient must be provided to us in the order confirmation form.
13.5 In the event that the goods are delivered to the customer’s requested delivery location and no authorised individual is available to sign for the package, our delivery personnel will not be able to leave the item at the customer’s delivery address. The customer will need to contact customer services to arrange to pick up the purchase at a designated location or arrange another delivery date.
13.6 If the customer requests for redelivery, the Gardens Shop is entitled to charge an additional fee for providing the service.
13.7 While we make every effort to deliver all customer goods within an agreed time, the Gardens Shop will not be liable if it fails to do so in part or in full due to circumstances beyond its control.
13.8 We aim to inform you if we find that we are unable to meet our estimated delivery time but to the extent permitted by law, we shall not be liable for any costs, losses, charges, damages or liabilities that may arise out of late delivery.
13.9 Please read our 'Shipping Terms' for more information regarding local and overseas delivery services.
13.10 Deliveries will be made only on working days. We apologise that there will be no deliveries made on Saturdays, Sundays, and Public Holidays.
13.11 When you receive your order, you must inspect the product immediately after delivery. If there are any damages or faults, contact us at email@example.com immediately and hold on to all documents and packaging that was received with the product.
13.12 All risks and responsibility for the products is passed on to the customer upon delivery. After delivery, the Gardens Shop will not be responsible for the loss or damage of the product.
13.13 Please note that there are some locations that are out of reach of the Gardens Shop delivery network. If we are unable to deliver to your location, we will contact you using the details you provided us in your order confirmation form and arrange for the cancellation of the order. If possible, we will arrange for the purchase to be delivered to an alternative delivery address.
13.14 The Gardens Shop delivers all our items in our standard packaging. Any special requests or additional packing requested by the customer is subject to additional fees.
13.15 If delivery or collection is postponed for an extended period of time due to an unreasonable refusal to accept delivery or if the customer does not collect the product from the carrier within 2 weeks of our first attempt at delivering the product, we may do one of the following:
13.16 We may charge you a reasonable storage fee and all other costs incurred by us to hold the product for the customer
13.17 We may cancel the contract made between the Gardens Shop and the customer for that particular purchase and no longer make the product available for delivery or collection. In the event of a cancellation of the contract, we will refund you the money paid to us for the product after deducting the reasonable administrative charges (including all delivery and storage charges)
14. CUSTOMER SERVICES
14.1 If you do not receive your order within 14 working days from the date of confirmation, please contact us at firstname.lastname@example.org.
14.2 We welcome all suggestions and comments from our valued customers to help us to continually improve our products and services. Please drop us your feedback at email@example.com.
15. CANCELLATION BY CUSTOMER
15.1 The Gardens Shop regrets that any cancellation after an order has been made will not be approved.
16. CANCELLATION BY THE GARDENS’ SHOP
16.1 The Gardens Shop may cancel an order if a product is not available for any reason. In the event of the unavailability of a purchased product, we will notify you and refund payment in full through the same method originally used to purchase the product.
17. PRODUCT GUARANTEE
17.1 The RISIS products that the Gardens Shop carries are plated in genuine 24-carat gold, rhodium or other precious metals unique to RISIS.
17.2 The RISIS products that the Gardens Shop carries a guarantee that covers any manufacturing defects for 1-2 years from the date of purchase, excluding normal wear and tear, as specified in the guarantee booklet that comes with your item.
17.3 Kindly retain your RISIS products guarantee booklet and produce it, should you require any after sales service.
18. RETURNS, EXCHANGES AND REFUNDS
18.1 When you shop with the Gardens Shop, delivering quality products in pristine condition is our top priority. However, we understand that there may be instances where a product needs to be returned.
18.2 While we take all the necessary precautions to ensure that orders leave our warehouse free of defect, we do acknowledge that human error may occur sometimes. Should you receive faulty, incorrect or damaged Gardens Shop merchandise, please contact us at firstname.lastname@example.org and we will resolve the matter as soon as possible. Because quality is of utmost importance to us, rest assured that we will handle the matter appropriately and quickly.
18.3 Faulty, incorrect or damaged Gardens Shop merchandise should be reported to email@example.com within 7 days of receipt of the product. The product should be returned in its original packaging. Do note that we would require pictures that clearly show the damage/fault to the product to be taken so that we can access the damage as well.
18.4 The Gardens Shop is not liable for any goods missing or damaged during the delivery of your return. The customer shall return goods at his/her own cost. A new undamaged item identical to the one purchased will be sent back to the customer. The new item will only be sent out once the faulty/damaged item has been returned.
18.5 The Gardens Shop will not cover the cost or refund shipping charges unless due to a company error.
19. UNCONTROLLABLE/UNFORSEEABLE CIRCUMSTANCES
19.1 The Gardens Shop shall not be liable for any delays or breach in the fulfilment of a contract that are a result of any natural disaster or uncontrollable event, actions of third parties (including, but not limited to, hackers, governments, war, hostilities, piracy, terrorism, arrests, national emergencies, strikes, epidemics, storms, floods, earthquakes, mechanical breakdowns) and all other uncontrollable circumstances.
20. THE GARDENS SHOP WEBSITE LIABILITY
20.1 While all attempts have been made to ensure that the information provided is reputable, of high quality and as accurate as possible, the Gardens Shop does not assert that product description or other content on this site is accurate, complete, reliable or error-free.
20.2 We have made every effort to display as accurately as possible the colour and size of all the items that appear on the Gardens Shop. However, as computer monitors may vary, we cannot guarantee that the colours displayed on your monitor will be completely accurate. We also ask that you keep in mind that some of the Gardens Shop products are made from real flowers so there may be slight variations in the size and shape of each bloom.
20.3 We will not be responsible for any errors or omissions or for the results obtained from the use of information or for any technical problems you may experience with the Gardens Shop website.
20.4 If there are any inaccuracies or oversights that you notice, please inform us at firstname.lastname@example.org and we will try to rectify the issue as soon as possible.
20.5 In particular, the Gardens Shop disclaims all liabilities in connection with the following:
- Technical problems including interruptions or errors of the Gardens Shop website
- Incompatibility of our website with any of your equipment, telecommunications or software
- Inaccuracy or unreliability of the Gardens Shop Online
- Inability of the Gardens Shop to meet your requirements
20.6 To the full extent allowed by applicable law, you agree that we will not be liable to you or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of anticipated savings, loss of profits, wasted expenditure, loss of privacy and loss of data) or any other indirect or punitive damages that arise out of our are related to the Gardens Shop website.
21. INTERNATIONAL USE
21.1 The Gardens Shop makes no promises that the materials on our website are appropriate or available for use in locations outside Singapore, and accessing the website from territories where its contents are illegal or unlawful is prohibited.
21.2 If you choose to access this site from locations outside Singapore, you do so at your own risk and are responsible for compliance with your country’s local laws.
22. AVAILABILITY OF THE GARDENS SHOP WEBSITE
22.1 Although the Gardens Shop aims to offer you the best service possible, we make no promise that the services at our website will meet your requirements. The Gardens Shop cannot guarantee that the service will be error free. If an error occurs at any point of time, you should report it by email to email@example.com and we will attempt to rectify the issue as soon as possible.
22.2 Please be aware that your access to the Gardens Shop website may occasionally be restricted to allow for repairs, maintenance and/or the introduction of new facilities or services. We will aim to restore the services as soon as possible.
23. INTELLECTUAL PROPERTY RIGHTS
23.1 Your use of the Gardens Shop Online and its contents does not grant you rights with regards to any designs, trademarks, copyright and other intellectual property rights relating to the content.
23.2 Usage of any content available on this site requires written approval from the Gardens Shop. Unless permission is granted, any reproduction or redistribution of the content on the Gardens Shop Online is prohibited. 24.1To further illustrate the intellectual property rights clause mentioned above, “Content” is defined as any images, photographs, graphics, audio, video, sound, and text on this site. While the Gardens Shop tries its best to ensure the accuracy of all the information provided on this site, it does not promise that the content is error-free. It also does not promise that the site is completely free of viruses or other harmful components. We advise all users to ensure that they use always up-to-date virus scan software.
24.2 By posting on our site, you acknowledge that you are solely responsible for all of the content that you contribute, including but not limited to reviews, ratings and comments. 26. NO COMMERCIAL USE
26.1 The Gardens Shop Online is for your personal use only. You may not distribute, transmit, display, modify, copy, reproduce, publish, exploit, transfer, or sell any content, products or services contained within this site.
27.1 You may not assign or transfer any of your rights under these Terms and Conditions.
27.2 If any part of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full effect.
27.3 If there is a breach of these Terms and Conditions and the Gardens Shop ignores it, the Gardens Shop will still be entitled to exercise its rights at a later date or in any other situation where you breach the Terms and Conditions.
27.4 The Gardens Shop shall not be held responsible for any breach of these Terms and Conditions caused by circumstances beyond its control.
28. CHANGES TO TERMS & CONDITIONS
28.1 The Gardens Shop reserves the right to amend the Terms and Conditions as deemed fit. If any substantial changes are made, you will be given ample notification.
28.2 You agree that your continued use of the Gardens Shop Online and services after such amendment(s) will establish your acceptance and agreement to be bound by the revised Terms and Conditions.
29. ACCEPTANCE OF TERMS AND CONDITIONS
29.1 By accessing, browsing and/or using the Gardens Shop Online, you agree to be bound by the Terms and Conditions set forth and to comply with all applicable laws and regulations.
30. TERMINATION OF YOUR ACCOUNT
30.1 The Gardens Shop reserves the right to terminate your account immediately if you breach any of your obligations under these Terms and Conditions.
